GDPR Privacy Notices

This privacy notice explains how we collect, store and use personal data in Venture Academy.

MacIntyre Academies collects and uses pupil information which complies with General Data Protection Regulation (GDPR). This is Europe's new framework for data protection laws – it replaces the previous 1995 data protection directive, which UK law has previously been based up

How we use Pupil Information
 
  • We gather pupil data (including personal contact information, ethnicity and special educational needs, medical conditions, any behaviour issues) as well as data about educational attainment (including attendance, exclusions, assessment results).
  • We gather this data to enable us to run our schools well, to support pupil learning and wellbeing and also to comply with the law. Whilst the majority of pupil information is mandatory, some of it is done on a voluntary basis. In order to comply with the General Data Protection Regulation, we will make it clear when there is a choice in providing information.
  • We do not share information about our pupils with anyone without consent unless the law and our policies allow us to do so.
  • We share pupils’ data with the Department for Education (DfE) on a statutory basis. This data sharing underpins school funding and educational attainment policy and monitoring.
  • We are required to share information about our pupils with the DfE under Regulation 5 of The Education (Information About Individual Pupils) (England) Regulations 2013.
  • We hold pupil data securely and retain records for no longer than is necessary. (see the attached Retention Schedule for specific details)
  • Under data protection legislation, parents and pupils have the right to request access to information about them that we hold.
  • When you have provided us with consent to use your data, you may withdraw this consent at any time.

How we use Staff Information
 
  • We gather information about people we employ (or prospective employees) and agency workers (including personal contact information, ethnicity, health and sickness information, salary, bank details, National Insurance) and recruitment information (including qualifications. employment records, performance / disciplinary / grievance information). 
  • We gather this data to enable us to run our schools well, to support staff performance and wellbeing and also to comply with the law. Whilst the majority of staff information is mandatory, some of it is done on a voluntary basis. In order to comply with the General Data Protection Regulation, we will make it clear when there is a choice in providing information.
  • We do not share information about our staff with anyone without consent unless the law and our policies allow us to do so.
  • We share staff data with the Department for Education (DfE) on a statutory basis under Section 113 & 114 of the Education Act 2005 and the Local Authority under Section 5 of the Education Regulations 2007.
  • We share staff data with the Disclosure and Barring Service (DBS) to meet our legal obligations to carry out criminal records for roles involving work with vulnerable children
  • We hold staff data securely and retain records for no longer than is necessary (see the attached Retention Schedule for specific details)
  • Under data protection legislation, staff have the right to request access to information about them that we hold.
  • When you have provided us with specific consent to use your data, you may withdraw this consent at any time

How we use Volunteers Information 
  • We gather information about people who volunteer with Venture Academy such as personal contact information and national insurance details.
  • This information is gathered through our Volunteer Recruitment process which consists of an application form, interview, references, confidentiality agreement, enhanced DBS check and where applicable an overseas check.  
  • We gather this data to enable us to run our schools well and also to comply with the law. Whilst the majority of volunteer information is mandatory, some of it is done on a voluntary basis. In order to comply with the General Data Protection Regulation, we will make it clear when there is a choice in providing information.
  • We do not share information about our volunteers with anyone without consent unless the law and our policies allow us to do so.

 Other Types of Data we process

 

CCTV 
  • Venture Academy uses closed circuit television (CCTV) and the images produced to prevent or detect crime and to monitor the school buildings and grounds in order to provide a safe and secure environment for its pupils, staff and visitors, and to prevent loss or damage to school property.
  • The school complies with the Information Commissioner’s Office (ICO) CCTV Code of Practice to ensure that CCTV is used responsibly and safeguards both trust and confidence in its continued use. The Code of Practice is published at: https://ico.org.uk/media/1542/cctv-code-of-practice.pdf

  • CCTV warning signs are clearly and prominently placed at the main external entrance to the school, including further signage in other outdoor areas in close proximity to camera positions. Signs will contain details of the purpose for using CCTV (see appendix B). In areas where CCTV is used, the school will ensure that there are prominent signs placed within the controlled area.

  • There will be no disclosure of recorded data to third parties other than to authorised personnel such as the Police and service providers to the school where these would reasonably need access to the data (e.g. investigators).

  • Requests for images / data should be made in writing to the Principal.

Photography and Videography 
  • Venture Academy and MacIntyre Academies Trust uses photographic images and videos in its publications and on its website and individual school websites.
  • We will not publish names of individuals alongside their photo and we will only use images of pupils with written parental or guardian consent.
  • We will only share your images for a specific purpose with a trusted third party for example printing our school calendar.
  • We may also use photographic images within Venture Academy for educational purposes only.
  • For any other use, written consent will be gathered.
Website 
  • MacIntyre Academies’ websites do not automatically capture or store personal information, other than logging the user's IP address and session information such as the duration of the visit and the type of browser used. This is recognised by the web server and is only used for system administration and to provide statistics.
  • If you want to email via the website, you will be asked to submit some personal information (e.g. your name and email address which enables us to provide you with information you require. Your message and details may be passed on to colleagues who are better able to answer your questions. We do not share this information with external organisations unless required to do so by law.

Job Applications 

To apply for a job within MacIntyre Academies, applicants are required to submit a paper or online application form. This also involves us sharing information with a third party to support our recruitment process.  Unsuccessful applicant information is kept for 13 months in line with our retention schedule (see below).

Sharing Information with NHS or Public Health England (PHE)
 

Public Health England

The Department for Education’s Guidance for Full Opening of Schools has confirmed that schools must not share the names or details of people with Coronavirus (COVID-19) unless essential to others. In many instances, it will not be necessary for us to share information with other organisations. 

However, occasionally the Public Health team may ask for limited amounts of personal information. The Public Health team for Warwickshire have confirmed that they will only ask for information in the following circumstances:

  • If there is a coronavirus outbreak, families may be contacted to advise on self-isolation and testing.
  • If an individual tests positive, families may be contacted to identify the source of infection, and to provide advice and support.

Where it is necessary to share information in one of the circumstances mentioned above, this information will be limited to:

  • Name
  • Date of birth
  • Year group
  • Parent/guardians contact number and/or email address
  • COVID-19 test results

If Venture Academy is contacted by Public Health, we will enquire as to why the information is needed before giving out the information. 

NHS Test and Trace

It is unlikely we will need to share pupil and staff information with NHS Test and Trace. Should Test and Trace become aware of a positive test within Venture Academy they will inform Public Health who will make contact with us to advise on any measures that must be taken. Therefore, it is unlikely that NHS Test and Trace will request any personal information. However, if we are approached for information, we will enquire as to why the information is needed and discuss with the DPO. 

With regards to visitors’ data in the event of a positive case, the Public Health team will advise if we need to make contact with any visitors who have been on the school premises.
